The present general terms and conditions of sale (“Terms and Conditions”) apply to all orders and all sales transactions onthe website www.bam-bam.be (the “Online Shop”) concerningthe products offered for sale on the website www.bam-bam.be (the “Products”). The website is owned and operated by Vandepoele Bram, with company number BE0681.623.651 (the "Seller", "we" or "us", as the case may be), that acts as the seller of the Products.
The placing of an order on www.bam-bam.be implies full acceptance without reservation of these General Terms and Conditions of Sale. The Seller reserves the right to modify these Terms of Sale from time to time. Any changes to the Terms will only apply to orders placed on or after the date of modification.
Orders placed on www.bam-bam.be are not binding to the Seller. They only become binding to the Seller once the Seller has accepted your order. We have the right to reject your order for any reason.
After receiving your order, we will send you a confirmation email of the receipt of your order with your order number and details of the ordered Products. This confirmation of receipt does not imply that your order has been accepted. The acceptation of your order and the conclusion of the sales contract will take place if and once the ordered Products are sent to you. After shipping the Products, we reserve the right to cancel your order as long as you haven’t received the Products yet.

In case we reject or cancel an order for any of the aforementioned reasons, we will – as the case may arise – refund the price paid for the product and the paid delivery charges.
The prices mentioned on the website www.bam-bam.be are inclusive of all relevant taxes. They only apply to orders placed on the website www.bam-bam.be. Although we have constructed the website www.bam-bam.be carefully, the prices shown may be in error. Any prices shown in error shall be modified as soon as possible and shall not be binding on us.
Separate costs for delivery and processing and applicable taxes will be shown when placing the order. The delivery charges will be shown in the Shopping Cart.
The presentation of the colours of the Products on this website depends amongst others on the settings of your monitor and the graphic card of the visitor of the website. The colours presented may therefore differ from the actual colours of the Products.
We do not have access to the confidential details of payment of our customers. Payment can only be made by authorized payment methods. The authorized methods are mentioned on the website www.bam-bam.be. You will need to provide the details of the payment method when you place your order. The costs will be charged when the ordered Products are dispatched. We will only dispatch the Products after the issuer of the card has authorized the use of the card for the payment of the ordered Products.
The Belgian Bill of Law on Commercial Practice, the Information and Protection of the Customer of April 12 2010, states that the purchaser has a time for reflection of 14 calendar days for all products bought from www.bam-bam.be. This period starts as soon as you or someone assigned by you has received the goods. During this period we expect you to handle the goods and the package material carefully. The right to cancel the purchase is not possible when the product and the package material are no longer original, undamaged and unused.
When you want to cancel the purchase, you must inform us by email within 14 calendar days following the day of delivery of the goods. Cancelling the purchase is not subject to any fines and a reason must not be given.
The goods must be returned undamaged, unused and unopened (in their original packaging) at the very latest 14 days after delivery. The shipping date is the control date. All documentation, certificates of guarantee and packing materials must be added to the return shipment, as well as the number of your bank account. The purchaser pays the shipping costs of the returned goods. Understamped or unstamped shipments are always refused and will be sent back to the purchaser.
We return the complete amount of the purchase, including shipping costs, within 30 days after the goods have been returned. If goods have not been returned in accordance with the conditions of the right to cancel, the amount of the purchase including the shipping costs, will not or not completely be returned. The product, in this case, remains your property. On your demand the goods can be sent back to you on the condition of payment of the shipping costs.

- Repayment is not possible when a product has been used or is damaged in any other way

Refunds can only take place after all Products have been returned to us in their original state and after we received them. When you chose to pay with credit card, you will be refunded on this card. When you chose to pay with bank transfer, we will deposit the refund on this account. All refunds are made within 15 days after receiving the returned Products.
We will do everything necessary to fulfil our obligations. We can, however, not be held liable for a delay or non-performance of our obligations in case this has been caused by circumstances outside our reasonable control. In case of delay, we will perform as soon as reasonably possible.
These Terms and Conditions set out the full extent of the Seller’s obligations and liabilities in respect of the supply of Products. To the maximum extent permitted by applicable law, there are no warranties, conditions or terms that are binding on the Seller except as expressly stated in these Terms and Conditions.
We are not liable on the basis of breach of contract, tort, indemnity or otherwise for any economic loss (including, but not limited to, any loss of income, profits and/or turnover or expected savings), loss of data, loss of goodwill or reputation damages, or any other indirect, unforeseeable, special or consequential damages, regardless how caused. Nothing in these Terms and Conditions shall limit your legal rights and nothing in these Terms and Conditions is intended to limit or exclude liability for fraud or wilful misconduct.
All personal data provided through the website www.bam-bam.be to the Seller will be treated in a confidential manner. The Seller engages itself to treat and process the personal data provided in accordance with the Belgian Act of December 8, 1992 on the protection of personal data. You have the right to access your personal data and to have inaccurate data corrected by sending a letter to the Seller. The personal data provided by you will be used for the purpose of managing our relationship with you as our customer, for direct marketing purposes and for the global imaging of our customer base. You can at all times and for free oppose to the use of your personal data for direct marketing purposes by sending a letter to the Seller.
